On the morning of October 10, Niko Black was alone and ill when deputies from the Orange County Sheriff’s Department arrived to evict her from her Garden Grove home on Shannon Avenue. “I’m in my bed and I see them storming my property,” she tells the OC Weekly. “I crawl to my wheelchair.”
The 37-year-old Mescalero Apache woman, who suffers from a rare, malignant and metastatic form of cancer, refused to open the door, saying that they had no legal right to be there. On the other side was a taped copy of a court order obtained from Federal Bankruptcy Judge Theodore C. Albert in late August that she firmly believes should have prevented the OCSD from carrying out the eviction. The deputies acted anyway. (OC Weekly)
“They break down my door,” Black recounts. “I’m sitting there in my wheel chair. I’m about 100 pounds of shriveled-up cancer and a threat to no one.”
Here’s the rub – Black had documents from a Judge that should have stayed the eviction order. She is now suing the O.C. Sheriff’s Department and Wells Fargo, the bank that had her evicted from her home.

I filed a Civil lawsuit against them and am filing Criminal charges, so they have been using the Sheriff and others, to harass me every week and try and bully me out hoping to get rid of me so they don’t get caught because they are in big trouble! That is why a Judge told them they are not allowed to harass me or try and remove me from my house because they have NO right! Now the Sheriff is trying to cover up what they did! They violated every law, The Constitution, The American’s with Disabilities Act, and put me in the hospital from injuring me. The US Marshal’s office and the FBI, which are above them, said that with my Proof in the Federal Court order, that the Garden Grove Police can let me back in my house immediately, but No one will do their job! They’d rather cover for the sheriff, and the fact I called them out to my house that day for protection, to up hold the law, and take a Police report… They did Nothing to protect me or up hold the law! They even refuse to take a police report of the multiple Crimes committed!crew demanded Niko out of her home on spot despite a Federal Court Order that granted her a non eviciton based on a bankruptcy hearing. Regardless they removed a helpless and sick friend from her home AT GUN POINT even!! We will not stand for such outrage!!”
