OC STREET by Kelly Robinson
Word is BOS Chairman Todd Spitzer will introduce a formal Resolution to Censure Judge Marc Kelly at tomorrow’s (April 14th) Board of Supervisors meeting. Joined by Supes Shawn Nelson and Lisa Bartlett, they appear to have the votes to pass the resolution.
A resolution like this could expose Judge Kelly to independent scrutiny from the dreaded California Council on Judicial Performance. The Council gets deeply troubled by judicial conduct that tends to undermine the public’s confidence in the bench, and this looks right up their alley.
Plus here is a bit of “inside baseball,” to keep an eye out for. Shawn Nelson has told friends he wants to run for Kelly’s seat if Kelly is in fact recalled. Shawn Nelson and OCDA Tony Rackauckas have been political friends for some time. Tony’s #2, OCDA Chief of Staff Susan Kang (Shroeder) is a close, close friend of Board member Michelle Steel. Do the math. Don’t be surprised if Steel climbs on board this train at tomorrow’s meeting.
But wait, there’s more. Board member Andrew Do has been pretty quiet about the controversy. Maybe that’s because he’s married to OC Superior Court Judge Cheri Pham, who is a colleague of the now injured and limping Kelly. Judges, like most other people, do tend to circle the wagons with that “one for all, all for one” attitude. Expect Do to quietly sit this one out – an abstention to avoid riling up the mob. (And don’t forget that Do himself is currently under investigation by the OCDA because of questions about his place of residence).
