If you live in the 37th State Senate district, which includes the cities of Huntington Beach (south), Costa Mesa, Newport Beach, Irvine, Tustin, Lake Forest, Laguna Beach,Laguna Woods, Villa Park, Orange, and Anaheim (east), you may have noticed a series of robo-calls invading your voice-mails lately on behalf of the establishment candidate for State Senate, Union-supported Assemblyman Don Wagner.
The Unions have already spent well over $100,000 on Independent Expenditure mailers and ads supporting Wagner, and the flood of Union money continues to pour in. I’ve been told that in just the last few days alone, Unions and Special Interests have spent over $60,000 on Wagner’s behalf, flooding voter’s voice-mails and mailboxes with lies and distortions targeted at the conservative in this race John Moorlach.
One particular deceptive robo-call making its rounds these days is paid for by the Law Enforcement and the Deputy Sheriff’s Union on behalf of Wagner. This particular robo-call features our District Attorney Tony Rackauckas telling us what a wonderful politician Don Wagner is on fiscal and criminal justice issues.
It starts out by Rackauckus, who has been our County D.A. for the past 16 years and is on his fourth term, making the laughable assertion that he usually doesn’t endorse candidates or get involved in races. This particular comment no doubt is the most ridiculous false statement of the entire recorded message!
Even folks who are moderately familiar with local politics and only occasionally follow local races know that Rackauckas, contrary to how D.A.’s should conduct themselves, is probably the most overtly political District Attorney that Orange County has ever had, especially as it relates to endorsing candidates!
In fact, I don’t recall a recent local high-profile race where Rackauckas hasn’t endorsed some liberal or GOP establishment candidate. It seems this guy injects himself in just about every local race of significance and candidates seem to fall all over themselves to seek his endorsement.
Just as recently as two months ago, Rackauckas endorsed a liberal Democrat, former State Senator Lou Correra, in that race for County Supervisor in North Orange County’s 1st Supervisorial District. Last year, Rackauckas appeared in television ads on behalf of the establishment in an attempt to defeat the conservative Mayor of Anaheim Tom Tait, who was running for re-election and is now a proud supporter of John Moorlach!
Call me old-school, but I think it is somewhat troubling for a supposed non-partisan law enforcement chief to be so overtly involved in the outcome of certain political races! D.A.’s are typically suppose to be removed from the political scene and are not to give even the hint that they have scores to settle with other elected officials. The often used lawerly phrase: “the appearance of impropriety” comes to mind when I think of Rackauckas’ frequent political endorsements.
Rackauckas, in my opinion, has certainly crossed a line as it relates to how a District Attorney should conduct himself as a non-partisan elected official. The fact that Tony Rackauckas would start out this Union-funded robo-call by claiming that he usually doesn’t get involved in races, is absurd and it frankly blows his whole credibility for the rest of the message!
Even more absurd, Rackauckas tells us, at the end of the message, that John Moorlach worked to “obstruct” his efforts to seek the death penalty for a convicted killer. This is probably the biggest whopper of them all so far from the Wagner camp, and that is saying something!
Nothing can be further from the truth! John Moorlach is a strong supporter of Capital Punishment and he has never advocated for the abolishment of the death penalty, nor has he ever obstructed our D.A. from seeking the death penalty for a particular convicted criminal!
Rather than me going into detail about what a whopper of a lie this is, I will direct your attention to John’s response below! I’ve asked John to write a response to this and I encourage you to read it over and share it with others!
Since literally thousands upon thousands of Union dollars are flooding into people’s mailboxes and voice-mails with lies and distortions about Moorlach’s record, I think it’s important, from this point forward, for all of us to be the truth police as it relates to this race! Once you see an obvious lie from the Wagner camp, I encourage you to speak out against it and to shine the sunlight of truth on it!
You see, John Moorlach doesn’t have hundreds of thousands of dollars in Union money trashing his opponent! He depends on us to get the truth out and to promote his excellent fiscally conservative record! Please spread John Moorlach’s response below via e-mail, Facebook and Twitter!

On March 17th, St. Patrick’s Day, let’s reject the politics of Union-funded lies and distortions! Let’s vote for a man who will take-on the Unions in Sacramento, instead of joining them! John Moorlach for State Senate!
Thankfully, these robo-calls tend to do more harm than good for a candidate. Political experts will tell you that robo-calls are generally hated by the voters and have the potential of backfiring!
Here is my response to the false accusations in the recent robo-calls on behalf of my opponent.
It was an academic question by my former law professor Chief of Staff, “Since the state is not executing individuals on death row, and it costs the County a quarter of a million dollars per trial to obtain a death sentence in murder trials, and we are in the Great Recession and laying off welfare fraud investigators in the District Attorney’s office, should we temporarily discontinue pursuing the death sentence to save the funds?”
I quickly told Tony Rackauckas that this was a debate between two lawyers and that I was supportive of pursuing the death penalty. So, the two would have an occasional debate. This banter spilled out into a staff meeting and Tony, instead of making an eloquent speech concerning the efficacy of his position, became quite irate and stormed out of the room.
To use this setting to claim that I oppose the death penalty is about as big of a stretch as one can make and is not very professional of individuals holding law degrees, like our D.A. and Michael Schroeder, a member of the D.A.’s informal political kitchen cabinet, in their robo-calls for my opponent.
P.S. For the record, I served as the Chair of the Orange County Criminal Justice Coordinating Counsel for most of my time as County Supervisor. Never once was this topic on the agenda of one of our monthly meetings. In fact, it is my recollection that Tony Rackauckas never attended one of the meetings and always sent an alternate. The Chief of Probation, the Public Defender, the Presiding Judge of the Orange County Superior Court, and the Sheriff-Coroner had great attendance records.
