Attorneys deal with facts. Politicians attempt to manipulate those facts to change public perception.
With regard to the ruling by the Sacramento Superior Court on Friday as it pertains to Anna Bryson’s ballot statement, the facts are clear: The Court did not dispute the fact that Anna Bryson saved the taxpayers of the Capistrano Unified School District $59 million. That fact never changed between the original ballot statement and the amended statement approved by the Court.
What was changed was the tense of the verb “return.” The fact that Anna Bryson voted to return $59 million to the District’s taxpayers was not challenged nor was it changed. Given that a portion of the monies to be returned have not yet made it onto the tax bills of the residents in the District, the Court felt that the use of the word “returned” with regard to the entire $59 million was anticipatory.
As such, once it was determined that the amount was correct and that Ms. Bryson’s votes were authentic, the only remaining issue was how to modify the statement to comply with the word restriction imposed on all ballot statements.
As to the verbiage attached to the actual ruling, the Court, in order to allow the modification, had to make a ruling pursuant to the Elections Code. The Elections Code mandates the terminology available to allow a court to modify a ballot statement. Therefore, the verbiage contained in the ruling is there pursuant to the dictates of the Elections Code and does not, as such, reflect the detailed and nuanced findings of the Court. To best understand those nuanced findings, one needs to look at the grammatical and substantive modifications made to the actual ballot statement. And, in this instance, those modifications are grammatical and not substantive.
